These Terms of Service govern your use of Who's AUX, including our website, products, Discovery Vinyl, Vinyl Club, Gift Vinyl Club, content, and related services.
By accessing our website or purchasing from Who's AUX, you agree to these Terms and the policies referenced in them.
About Who's AUX
Who's AUX is a music-discovery platform built around people, records, context, conversation, and curation.
Eligibility
By using our services or placing an order, you represent that you are legally able to enter into a binding agreement or have appropriate permission to do so.
Products and availability
Products, prices, features, availability, and descriptions may change from time to time.
We may limit quantities, discontinue products, correct errors, or cancel orders when reasonably necessary.
Product photography and creative imagery may be illustrative. Individual curated record selections will vary.
Discovery Vinyl
Discovery Vinyl is sold as a curated music-discovery product.
Unless a product specifically identifies an album or artist by name, the exact record is selected by Who's AUX rather than by the customer.
Selections may be new or quality pre-owned and generally draw from approximately the last 50 years of music.
By purchasing Discovery Vinyl, you are purchasing our curation rather than a specific undisclosed album.
Vinyl Club
Vinyl Club is a recurring curated vinyl subscription.
The number of records included in each delivery depends on the membership tier purchased. Current tiers may include:

Trust Us — 1 curated record per month

Curator — 2 curated records per month

Collector — 3 curated records per month
Records may be new or quality pre-owned.
Who's AUX determines the specific record selections. By purchasing Vinyl Club, you are purchasing our curation rather than the right to choose specific album titles.
Vinyl Club follows the monthly selection and fulfillment schedule described in our Shipping Policy. Standard recurring memberships continue until canceled according to our Purchase Options Cancellation Policy.
Promotional trials
Who's AUX may occasionally offer a promotional Vinyl Club trial.
Trial availability, duration, and terms are those shown when the membership is purchased. The current 30-day trial applies only when it is expressly offered at checkout.
When a physical trial shipment is provided, cancellation without paying for that shipment requires the records to be returned according to our Return & Refund Policy.
Promotional trials may be changed, withdrawn, or unavailable for future purchases without changing the terms already accepted for an active trial.
Gift Vinyl Club
Gift Vinyl Club is a prepaid fixed-term membership.
The purchaser selects a membership tier and a 3-, 6-, or 12-month term and pays the applicable amount upfront.
Gift Vinyl Club does not automatically renew when its prepaid term ends.
Orders
We reserve the right to reject, cancel, or limit an order when reasonably necessary, including in cases of:

Misuse of the store

Inability to fulfill the order
If we cancel a paid order and do not provide the purchased goods or service, the applicable payment will be refunded.
Pricing and payments
Prices are shown on the website and may change from time to time.
Applicable taxes, shipping, and other charges are displayed when required during checkout.
Payment processing is provided through Shopify and applicable payment providers.
You agree to provide current and accurate purchase and account information.
For recurring subscriptions, you authorize recurring charges according to the price and frequency disclosed when you purchase the subscription.
Any changes affecting existing recurring subscriptions will be handled in accordance with applicable requirements and the terms communicated to the subscriber.
Shipping
Shipping and fulfillment are governed by our Shipping Policy.
Returns and refunds
Returns, damaged products, replacements, and refunds are governed by our Return & Refund Policy.
Subscription cancellation
Recurring subscription cancellation, pausing, skipping, and membership changes are governed by our Purchase Options Cancellation Policy.
Music recommendations and community submissions
Who's AUX is meant to be participatory.
You may voluntarily submit artists, records, songs, music recommendations, connections between music, context, stories, comments, opinions, playlist suggestions, links, original work, or other ideas or material.
By submitting something to Who's AUX, you authorize us to review it, retain it, contact you about it, and consider the ideas or information contained in it when developing or curating Discovery Vinyl, Vinyl Club deliveries, playlists, listening recommendations, products, community programming, or editorial concepts.
Submission does not guarantee selection, publication, inclusion, response, compensation, credit, a partnership, or another business relationship.
You retain ownership of original material that you own.
Submitting an idea, recommendation, concept, artist, or musical connection does not prevent Who's AUX from independently developing, receiving, recommending, or using the same or a similar idea from another source.
You must not knowingly submit material in a manner that violates another person's rights.
Intellectual property
Unless otherwise stated, Who's AUX branding, site design, written content, original graphics, product designs, game materials, photography owned by us, and other original material are owned by or licensed to Who's AUX.
You may not reproduce, sell, commercially exploit, or distribute our original materials without permission except where permitted by law.
Artist names, music, album artwork, trademarks, photographs, and other third-party materials remain the property of their respective rights holders.
Their appearance on Who's AUX does not imply ownership by Who's AUX.
Acceptable use
You may not use Who's AUX to violate applicable law, interfere with site operation or security, attempt unauthorized access, introduce malicious code, commit fraud, impersonate another person, infringe intellectual-property rights, harvest information without authorization, or use our content for unauthorized commercial copying or resale.
Third-party services and links
Who's AUX may link to or integrate with third-party services, including music platforms, social networks, Shopify, subscription-management providers, payment providers, and publishing platforms.
Those services are governed by their own terms and policies.
We are not responsible for third-party services that we do not control.
Disclaimer
We make reasonable efforts to accurately describe our products and operate Who's AUX reliably.
Except where prohibited by law, the website and services are provided without guarantees beyond those expressly stated in these Terms or required by applicable law.
Limitation of liability
To the maximum extent permitted by applicable law, Who's AUX and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site or services.
Nothing in these Terms excludes liability that cannot legally be excluded.
Indemnification
To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful misuse of the site, infringement of another person's rights, or violation of these Terms.
Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Changes
We may update these Terms from time to time.
The version posted on this page with the most recent update date will apply going forward.
Governing law
These Terms are governed by the laws of Maryland, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
